The civil works to be funded from the loan will cover about 108km. The M-03 road connects the industrial areas in eastern Ukraine to Kiev, and is also part of the European road corridor E-40. Physical works will include the rehabilitation of the existing 4-lane road sections and the widening of other sections from two to four lanes, to ensure that the entire road is in line with the Ukrainian motorway standard. In addition to the increase in road capacity and the improvement of road conditions, this component will result in major road safety benefits. Widening to four lanes will greatly reduce the risk of head-on collisions, which are today the main cause of crashes and traffic fatalities of this road. The second component is road safety improvements. This component will finance two types of activities: (i) safety improvements along several high risk road corridors; and (ii) introduction of improved road safety features on the existing M-03 sections in urbanized areas which will remain even after bypasses will be built around those under component one. For the former, a comprehensive road safety assessment is being carried out under the ongoing RSIP, using the risk mapping and star rating approach of the International Road Assessment Program (IRAP). The third component is institutional support and strengthening. Under this component the Bank will complement the institutional assistance already being provided by other development partners, in support of the Government's concept for the road sector reform program enacted through the Cabinet of Ministers dated August 3, 2011. This project paper seeks the approval of the Executive Directors to provide an additional loan in an amount of US$150 million to Joint Stock Company The Export-Import bank of Ukraine (Ukreximbank or UEB) with the guarantee of Ukraine as Additional Finance (AF) to EDP2. The additional loan would help finance scaled-up activities of EDP2 to enhance the impact of a well-performing credit line to Ukrainian exporters. The resumption of growth of the Ukrainian economy is particularly dependant on the pick-up in exports in the post-crisis environment. UEB has been particularly effective in extending sub-loans directly to exporters throughout the crisis period (2009-2010), after participation of the intermediating local banks was temporarily suspended due to the worsening of their financial condition and violation of eligibility criteria in late 2008-early 2009. Going forward, EDP2 AF credit line would be extended both by UEB directly, and through resuming or new participating banks, thus enhancing the reach of the project. No changes to the current project design are there. Expected outcomes from the activities to be supported with additional financing would relate to increased exports of the Ukrainian corporate sector in the short term, its enhanced capacity to sustain and grow exports in the medium- to long-term, and improvements in its average cost (reduction) and maturity (extension) of funding. The components of the project includes: Ukreximbank has a successful track record of lending to industrial companies for energy efficiency projects under a parallel credit line provided by the European Bank for Reconstruction and Development (EBRD). Lending to municipal energy efficiency projects is inherently more risky, as municipalities creditworthiness is challenged by political interference in tariff setting, limited borrowing capacity and collateral limitations. Commercial debt financing and equity co-financing will be drawn on to co-finance projects; additional grant co-funding may also become available through potential future climate finance and the Eastern European energy efficiency and environment partnership. The borrower will also on-lend to other eligible financial institutions - participating banks (PBs) - that are willing to invest in eligible energy efficiency projects in the industrial and municipal sector. While the country has made major strides in advancing democratic development, political and media freedoms, economic reforms, and enforcement of property rights, it has also experienced continuous political volatility. Domestic politics are highly contested, constitutional arrangements on the division of powers between the president and the parliament remain unclear, and the judiciary has become largely politicized and undermined as an independent institution. The operation builds on the achievements of the previous operations in the programmatic series and carries forward the three-pillar agenda, namely: (i) improving the investment climate to sustain growth; (ii) creating fiscal space for growth through strengthened public finances and public sector reforms; and (iii) improving service delivery and social inclusion. As regards to improving the investment climate, this operation supports the enactment of a law on joint stock companies. This law is breakthrough legislation on corporate governance that will encourage transparency in corporate practices, promote Foreign Direct Investment (FDI), and reinvigorate the securities market. It also supports a package of legislative and regulatory measures that lay out initial steps in building a framework to rehabilitate the banking system. This operation also supports executive actions to reduce the quasi-fiscal deficit in the energy sector as well as to improve the business environment for new firm growth by reducing the frequency and costs of business inspections. In terms of fiscal policy and public administration, the Third Development Policy Loan (DPL-III) supports a new procurement framework, which signals the commitment of the government to increased efficiency and transparency in public spending. As in prior operations, the DPL also supports a deficit target for 2007 and 2008. There are also a number of measures supported by the DPL geared to improving tax policy, tax administration, and budgeting practices.
