The Rural Land Titling and Cadastre Development Project for Ukraine will establish a national cadastre and title registry system, allocate land parcels to individuals in rural areas on an equitable basis, establish their property rights by issuing state deeds for land, and encourage the restructuring of farms into more efficient units. The changes are made to cancel the sum of US$11,850,000 from savings. The project is at moderately satisfactory status. It is progressing towards meeting the development objective within the time frame of the project and is expected to meet all targets before the end of the project period. The progress with completing large mapping contracts that are required in order to produce cadastral index maps is behind schedule and for this reason the project is classified as only moderately satisfactory.

The development objectives of the Second Roads and Safety Improvement Project (RSIP) are an improved condition and quality of sections of the M-03 road and increased safety on roads in Ukraine. There are three components to the project. The first component is road rehabilitation. This component will finance the rehabilitation and upgrading of the M-03 road between Lubny and Poltava. The civil works to be funded from the loan will cover about 108km. The M-03 road connects the industrial areas in eastern Ukraine to Kiev, and is also part of the European road corridor E-40. Physical works will include the rehabilitation of the existing 4-lane road sections and the widening of other sections from two to four lanes, to ensure that the entire road is in line with the Ukrainian motorway standard. In addition to the increase in road capacity and the improvement of road conditions, this component will result in major road safety benefits. Widening to four lanes will greatly reduce the risk of head-on collisions, which are today the main cause of crashes and traffic fatalities of this road. The second component is road safety improvements. This component will finance two types of activities: (i) safety improvements along several high risk road corridors; and (ii) introduction of improved road safety features on the existing M-03 sections in urbanized areas which will remain even after bypasses will be built around those under component one. For the former, a comprehensive road safety assessment is being carried out under the ongoing RSIP, using the risk mapping and star rating approach of the International Road Assessment Program (IRAP). The third component is institutional support and strengthening. Under this component the Bank will complement the institutional assistance already being provided by other development partners, in support of the Government's concept for the road sector reform program enacted through the Cabinet of Ministers dated August 3, 2011. This component will support: (i) the development of a strategic program for road sector development until 2030; and (ii) the enhancement of the capacity of Ukravtodor, the Ukrainian State Institute for Design of Roads (Ukrdiprodor) and other Ukrainian institutions, for designing and building safer roads. Technical assistance will be provided to help Ukravtodor in developing a strategic program for road development, covering also institutional strengthening, financial sustainability and the social and gender dimension of the program.

The First State Tax Service Modernization Project (STSMP) seeks to support a long-term and comprehensive modernization of tax administration in Ukraine by establishing sound organizational and operational foundations for the State Tax Service (STS). The Organization and Management (O&M) Modernization component will consist of several components, the first of which, strategic project management, will build on the State Tax Administration's capacity to implement major strategic projects through design, planning, testing and project management. Organizational consolidation, the second sub-component of the O&M component addresses the consolidation of the STS's organizational structure. Human resource management the third sub-component focuses on priority-tactical needs in the area of human resource management. Management capacity building, the fourth sub-component, addresses priority-tactical needs in the area of executive and middle management. Legislative and statistical analysis, the fifth sub-component, addresses priority-tactical needs in the area of legislative and statistical analysis. Stakeholder relations, the sixth sub-component, addresses a combination of priority-tactical and strategic needs in the management of the STS's relations with its external and internal stakeholders. The Operations Modernization component will consist of: a prototype core tax administration operation comprised by prototype support and implementation; a customer service call center; compliance strengthening; and large taxpayer office operations support.

The objectives of the Second Export Development Project (EDP2) for Ukraine are to provide medium and long term working capital and investment finance to private exporting enterprises to assist the guarantor's private exporting sector; and further improve the ability of the banking sector to provide financial resources to the enterprise sector through development of intermediation by expanding private financial institutions' lending products. This project paper seeks the approval of the Executive Directors to provide an additional loan in an amount of US$150 million to Joint Stock Company The Export-Import bank of Ukraine (Ukreximbank or UEB) with the guarantee of Ukraine as Additional Finance (AF) to EDP2. The additional loan would help finance scaled-up activities of EDP2 to enhance the impact of a well-performing credit line to Ukrainian exporters. The resumption of growth of the Ukrainian economy is particularly dependant on the pick-up in exports in the post-crisis environment. UEB has been particularly effective in extending sub-loans directly to exporters throughout the crisis period (2009-2010), after participation of the intermediating local banks was temporarily suspended due to the worsening of their financial condition and violation of eligibility criteria in late 2008-early 2009. Going forward, EDP2 AF credit line would be extended both by UEB directly, and through resuming or new participating banks, thus enhancing the reach of the project. No changes to the current project design are there. Expected outcomes from the activities to be supported with additional financing would relate to increased exports of the Ukrainian corporate sector in the short term, its enhanced capacity to sustain and grow exports in the medium- to long-term, and improvements in its average cost (reduction) and maturity (extension) of funding. AF for EDP2 is as the fastest and lowest cost instrument to improve access to finance for export-oriented enterprises as the economy recovers from the crisis.

The Social Assistance System Modernization Project seeks significant improvement of the effectiveness of Ukraine's social assistance system by better targeting of the cash benefits and reduction of burden on beneficiaries. The project consists of the following components: Component 1) will focus on modernization and improvement of the capacity of the local and regional social welfare offices to enable delivery of better quality services to clients. It will support organizational and operational reforms, transformation of social assistance from a disjoint set of program-specific arrangements to a unified, function-based and client-oriented structure. It will develop capacities that would enable effective implementation of the ongoing social assistance reform program. Component 2) will aim to build the Ministry of Labor and Social Policy (MOLSP) capacity for development of social assistance policies, with the systemic approach to monitoring program outcomes and policy impacts. It will also develop capacity of local and regional social welfare offices to outreach to the poorest parts of the population with an effort to include them into the social assistance programs financed by the Government. Component 3) will aim to strengthen institutional capacity of the MOLSP for efficient and effective implementation of the program.

The development objective of the Energy Efficiency Project is to contribute to improved energy efficiency by industrial and commercial companies, municipalities, municipal sector enterprises and energy service companies by facilitating sustainable financial intermediation for the financing of energy efficiency investments. The components of the project includes: Ukreximbank has a successful track record of lending to industrial companies for energy efficiency projects under a parallel credit line provided by the European Bank for Reconstruction and Development (EBRD). Lending to municipal energy efficiency projects is inherently more risky, as municipalities creditworthiness is challenged by political interference in tariff setting, limited borrowing capacity and collateral limitations. Commercial debt financing and equity co-financing will be drawn on to co-finance projects; additional grant co-funding may also become available through potential future climate finance and the Eastern European energy efficiency and environment partnership. The borrower will also on-lend to other eligible financial institutions - participating banks (PBs) - that are willing to invest in eligible energy efficiency projects in the industrial and municipal sector. This will improve the capacity of local financial institutions to identify and evaluate potential energy efficiency investments.

The objectives of the First Programmatic Financial Rehabilitation Development Policy Loan Program are to: (i) support a sound banking sector recapitalization program and restructuring process; (ii) enhance the legal framework for bank resolution; and (iii) strengthen the deposit insurance payout functions. Ukraine is a lower middle income country. It lags its eastern European neighbors in structural reforms, but has made important progress in some key areas, such as World Trade Organization (WTO) membership. Ukraine is an open economy and strongly supports closer integration with the European Union, and a new association agreement is under negotiation to be signed in the near future, including a deep and comprehensive Free Trade Agreement (FTA), which will anchor important institutional and structural reforms. At the same time, the country continues to suffer from corruption, despite a significant improvement in the environment for voice and participation since the political events of late 2004, often referred to as the 'orange revolution'.

Ukraine has been beset by political volatility over the past three years. While the country has made major strides in advancing democratic development, political and media freedoms, economic reforms, and enforcement of property rights, it has also experienced continuous political volatility. Domestic politics are highly contested, constitutional arrangements on the division of powers between the president and the parliament remain unclear, and the judiciary has become largely politicized and undermined as an independent institution. The operation builds on the achievements of the previous operations in the programmatic series and carries forward the three-pillar agenda, namely: (i) improving the investment climate to sustain growth; (ii) creating fiscal space for growth through strengthened public finances and public sector reforms; and (iii) improving service delivery and social inclusion. As regards to improving the investment climate, this operation supports the enactment of a law on joint stock companies. This law is breakthrough legislation on corporate governance that will encourage transparency in corporate practices, promote Foreign Direct Investment (FDI), and reinvigorate the securities market. It also supports a package of legislative and regulatory measures that lay out initial steps in building a framework to rehabilitate the banking system. This operation also supports executive actions to reduce the quasi-fiscal deficit in the energy sector as well as to improve the business environment for new firm growth by reducing the frequency and costs of business inspections. In terms of fiscal policy and public administration, the Third Development Policy Loan (DPL-III) supports a new procurement framework, which signals the commitment of the government to increased efficiency and transparency in public spending. As in prior operations, the DPL also supports a deficit target for 2007 and 2008. There are also a number of measures supported by the DPL geared to improving tax policy, tax administration, and budgeting practices. In terms of social areas, this operation supports focused achievements in implementing education quality measurements and higher transparency mechanisms in access to higher education.
